KINTON Ramen - Summer Ramen Tour Contest
Official Rules and Terms & Conditions (the “Rules”)
The "KINTON Ramen Summer Ramen Tour" Stamp Card Contest (the "Contest") is organized by
KINTON Ramen Canada Inc. (“KINTON Ramen” or “Sponsor”) and is open to legal residents of
Ontario, Quebec, Alberta, Manitoba, and British Columbia, who are eighteen (18) years of age
or older at the time of entry. Eligible entrant's who at the time of entry have reached the
age of eighteen (18) but have not reached the legal age of majority in their province of
residence at the time of participation (“Minors”) must obtain consent from a parent/legal
guardian to participate in the Contest and such parent/legal guardian must accept and agree
to be legally bound by these Rules on the Minor's behalf. No purchase is necessary to enter
or win.
NOTE TO MINORS: The Sponsor reserves the right, in its sole and absolute discretion, on a
random audit basis to contact a Minor's parent/legal guardian for the purposes of verifying
their: (i) agreement to be legally bound by these Rules on the Minor's behalf; (ii) consent
to the Minor's participation in this Contest; and/or (iii) consent to the collection, use
and disclosure of the Minor's personal information. Failure of a Minor's parent/legal
guardian to complete any such required verification to the complete satisfaction of the
Sponsor within the time frame specified by the Sponsor may, in the sole and absolute
discretion of the Sponsor, result in disqualification of the Minor.
1. Contest Period
The Contest runs from April 28, 2025 to September 28, 2025 (the "Contest Period"). Stamp
cards must be submitted in-restaurant by September 30, 2025 to be eligible to receive a Draw
Entry (defined below).
2. How to Enter and Rewards
To participate in the Summer Ramen Tour Contest, first you must visit a participating KINTON
Ramen
restaurant in Canada (a “Participating Restaurant”) and obtain a Summer Ramen Tour stamp
card (a
“Stamp Card”).
Participants will receive one (1) stamp for each ramen bowl purchased (an “Eligible
Purchase”)
at a
Participating Restaurant as an eat-in order (an “Eligible Transaction”). For greater
certainty,
take-out, delivery, or third-party app orders do not qualify as an Eligible Transaction and
are
not
eligible to receive stamps. There is a limit
one
(1)
stamp per person in relation to each
Eligible
Transaction, however, multiple participants may earn one (1) stamp from the
same
Eligible
Transaction, provided multiple Eligible Purchases have been made. As a representative
example
only,
if in a single Eligible Transaction, a participant purchases two (2) ramen bowls as an
eat-in
order
for themselves and their guest, the participant and guest will each be eligible to receive
one
(1)
stamp (provided the guest is eligible to participate). However, if the same participant
purchases
three (3) ramen bowls for themselves and their guest, the participant and guest will remain
eligible
to receive one (1) stamp each.
Reward Tiers:
Participants who have collected stamps on their Stamp Card in accordance with these Rules,
will
be
eligible to receive rewards in accordance with the following:
- After three (3) stamps: one (1) free dessert, subject to availability
- After six (6) stamps: one (1) free side dish (excluding Donburi and Karaage items)
- After nine (9) stamps: one (1) free ramen + one (1) bonus stamp for KINTON Bowlers + one
(1)
entry into the Grand Prize (defined below) draw (a “Draw Entry”)
All KINTON Bowlers stamps earned are subject to
the
terms
and conditions governing the KINTON BOWLER PROGRAM.
Stamp cards must be submitted in person to a
KINTON
Ramen
staff member at a Participating Restaurant before September 30, 2025, to qualify for the
final
reward and receive one (1) Draw Entry.
After a participant has callected nine (9) stamps and submitted their Stamp Card to a KINTON
Ramen
staff
member, in accordance with these Rules, Participants must complete the contest entry form
(which
may
include, without limitation, a requirement to submit the participant's full name and email
address)
which will be provided by a KINTON Ramen staff member on a tablet form when submitting their
completed Stamp Card (an “Entry Form”). This contact information will be used solely to
notify
the
winner. Once the foregoing steps have been completed in accordance with these Rules, each
participant will be eligible to receive one (1) Draw Entry.
No Purchase Necessary:
Alternatively, to obtain one (1) Draw Entry without completing an Eligible Purchase as
described above, print your first name, last name and valid email address, on a plain white
piece of paper and mail it (in an envelope with sufficient Canadian postage) along with a
fifty (50) word or more unique and original handwritten essay explaining Why do you want to
enter the Contest? to: 294 College St, Toronto, ON M5T 1R9 (an “Entry Request”). Upon
receipt of a valid Entry Request submitted and received in accordance with these Rules, you
will be eligible to receive one (1) Draw Entry. To be eligible, the Entry Request you submit
must: (i) be received separately in an envelope bearing sufficient Canadian postage (i.e.
multiple Entry Requests in the same envelope will be void); and (ii) be received no later
than October 8, 2025.
Participation Requirements:
If it is discovered by the Sponsor (using any evidence or other information made available to
or
otherwise discovered by the Sponsor) that any person has attempted to create false stamps,
use
multiple names, multiple identities, multiple email addresses, any automated, macro, script,
robotic
or other system(s) or program(s) and/or any other means not in keeping with the Sponsor's
interpretation of the letter and/or spirit of these Rules to enter or otherwise participate
in
or to
disrupt this Contest; then they may be disqualified from the Contest in the sole and
absolute
discretion of the Sponsor. Your Draw Entry may be rejected or denied if (in the sole and
absolute
discretion of the Sponsor) your Stamp Card/Entry Form/Entry Request (as applicable) is not
fully
completed with all required information and submitted and received in accordance with these
Rules.
The Contest Parties (defined below) and each of their respective officers, directors,
agents,
representatives, successors and assigns (collectively, the “Released Parties”) are not
responsible
for (and have no liability in relation to) late, lost, misdirected, delayed, incomplete or
incompatible Entry Forms, Entry Requests, Draw Entries and/or other information (all of
which
are/is
void).
3. Grand Prize Details
There is one (1) grand prize (the “Grand Prize”) available to be won, consisting of a travel
prize
for the confirmed winner and one (1) guest (a “Guest”), including:
- Round-trip economy airfare from Canada to Tokyo, Japan
- Six (6) nights of accommodation in a 3-star Tokyo hotel
- $500 CAD cash allowance
Approximate Retail Value (ARV): $5,500 CAD (based on a hypothetical Toronto, Ontario
departure)
4. Prize Conditions
- Travel must be completed between October 20, 2025 and March 31, 2026
- Blackout dates may apply, including major holidays
- Winner must possess a valid passport and be eligible to enter Japan
- Winner must provide proof of valid travel insurance prior to booking
- The Grand Prize is non-transferable, non-exchangeable, and non-redeemable for cash
- If the winner is unable to fulfill these conditions, the Grand Prize may be forfeited
- KINTON Ramen reserves the right to substitute a prize of equal or greater value if
necessary
Without limiting the generality of the foregoing, the following general conditions apply to
the
Grand
Prize: (i) Grand Prize must be accepted as awarded and is not transferable, assignable
and/or
convertible to cash (except as may be specifically permitted by Sponsor in its sole and
absolute
discretion); (ii) no substitutions are permitted, except at Sponsor's option; (iii)
participation in
the Grand Prize must occur within the dates specified by the Sponsor (otherwise the Grand
Prize
may,
in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if
forfeited,
nothing will be substituted in its place); (iv) the confirmed Grand Prize winner and their
Guest
must have all necessary documentation to permit participation in the Grand Prize; (v) the
costs
of
everything not specifically and expressly stated above as included in the Grand Prize are
the
sole
and absolute responsibility of the confirmed Grand Prize winner and their Guest, including,
without
limitation: meals and drinks; gratuities; entertainment; health and travel insurance;
transportation
for confirmed Grand Prize winner and their Guest to and from the departure location selected
by
the
Sponsor; additional transportation; baggage and other fees; and items of a personal nature
(NOTE:
confirmed Grand Prize winner and/or their Guest may be required to present a valid major
credit
card
in their name at the time of hotel check-in to cover any incidental expenses); (vi) if the
confirmed
Grand Prize winner and/or their Guest do not utilize any part(s) of the Grand Prize, then
any
such
part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited
in
their
entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor
reserves
the
right at any time to: (a) place reasonable restrictions on the availability or use of the
Grand
Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof
for
any
reason with a prize or prize component(s) of equal or greater retail value, including,
without
limitation, but solely at the Sponsor's sole discretion, a cash award; (viii) all
arrangements
relating to the Grand Prize must be made through the Sponsor or its designated agents; and
(ix)
by
accepting the Grand Prize, the confirmed Grand Prize winner agrees to waive all recourse
against
the
Sponsor and all of the other Released Parties relating to their participation in the Grand
Prize
(including any and all injuries) and/or if the Grand Prize or a component thereof does not
prove
satisfactory, either in whole or in part.
Guest Requirements: The confirmed Grand Prize winner's Guest must: (a) be
eighteen
(18) years of age or older, and if a Minor, must have obtained permission from their legal
parent or
guardian to participate in the Grand Prize ; and (b) sign (and if a Minor - such Minor's
parent/legal guardian must sign) and return the Sponsor's release (by the date indicated on
the
release form) indicating that they waive all recourse against the Sponsor and all of the
other
Released Parties relating to their participation in the Grand Prize (including, without
limitation,
any travel related thereto).
It is strongly recommended and encouraged that the confirmed Grand Prize winner and their
Guest
obtain sufficient personal travel and medical insurance prior to departure. Transportation
is
subject to availability, blackout periods, government restrictions and regulations, or other
transportation restrictions and regulations.
The Sponsor and the other Released Parties will not be responsible in the event that any
portion
of the Grand Prize is delayed, cancelled, postponed or rescheduled for any reason
whatsoever,
including without limitation, by reason of COVID-19.
IMPORTANT NOTE RE: COVID-19: In order to
participate
in
the Grand Prize, the confirmed Grand Prize winner and their Guest will be required to
strictly
follow all then current COVID-19 protocols. Failure of the confirmed Grand Prize winner
and/or
their Guest to comply with these requirements will result in the inability to
participate in
the
Grand Prize (and will therefore result in forfeiture of the Grand Prize in the sole and
absolute
discretion of the Sponsor).
Neither the confirmed winner nor their Guest nor any other person or entity will be
compensated
in
the event of such delay, cancellation or other event contemplated herein. The Sponsor will
not
replace any lost or stolen tickets. Changes to transportation, accommodations and or
passenger
names
are not accepted once bookings have been confirmed.
5. Winner Selection and Notification
The winner will be selected via random draw, from among all Draw Entries received during the
Contest
Period, on or around October 15, 2025 at the KINTON Ramen head office in Ontario. The winner
will be
contacted via the email address submitted through the tablet form. Odds of being selected
depend
on
the number of eligible Draw Entries received in accordance with these Rules.
If the winner does within seven (7) days, sign and return the Sponsor's declaration and
release
form,
in accordance with Rule 6 below, or is found ineligible, a new draw may be conducted.
6. Eligible Winner Confirmation Process
NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS THEM AS THE WINNER IN
ACCORDANCE
WITH THESE RULES. BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER, each eligible winner
will
be
required to: (a) correctly answer a mathematical skill-testing question without mechanical
or
other
aid (which may, in the sole and absolute discretion of the Sponsor, be administered online,
by
email
or other electronic means, by telephone, or in the Sponsor's form of declaration and
release);
and
(b) sign and return within seven (7) days of notification the Sponsor's declaration and
release
form, which (among other things): (i) confirms compliance with these Rules; (ii)
acknowledges
acceptance of the Grand Prize (as awarded); (iii) releases the Sponsor and all of the other
Released
Parties from any and all liability in connection with this Contest, their participation
therein
and/or the awarding and use/misuse of the Grand Prize or any portion thereof; and (iv)
agrees to
the
publication, reproduction and/or other use of their name, city and province/territory of
residence,
voice, statements about the Contest and/or photograph or other likeness without further
notice
or
compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor
in
any
manner whatsoever, including print, broadcast or the internet. If an eligible winner: (a)
fails
to
correctly answer the skill-testing question; (b) fails to return the properly executed
Contest
documents within the specified time; (c) cannot accept (or is unwilling to accept) the Grand
Prize
(as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all
as
determined by the Sponsor in its sole and absolute discretion); then they will be
disqualified
(and
will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole
and
absolute discretion and time permitting, to randomly select an alternate eligible entrant
from
among
the remaining eligible Draw Entries in accordance with these Rules (in which case the
foregoing
provisions of this section shall apply to such newly selected eligible winner).
7. Eligibility Restrictions
This Contest is not open to employees, representatives, or immediate family members of KINTON
Ramen,
its affiliates, or advertising/promotional agencies (collectively, the “Contest Parties”).
8. Privacy Policy
Personal information collected through this Contest will only be used for the administration
of
the
Contest and in accordance with applicable Canadian privacy legislation and in accordance
with
Sponsor's privacy policy (available at: https://kintonramen.com/privacy-policy/).
Information
will
not be shared or sold.
9. General Conditions
By participating, entrants agree that they have read and will abide by these Official Rules
and
the
decisions of the Contest Sponsor and administrators, if applicable, which shall be final and
binding
in all matters.
This Contest is subject to all applicable federal, provincial and municipal laws.
ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR'S INTERPRETATION OF THE LETTER
AND/OR
SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE
DISCRETION OF THE SPONSOR AT ANY TIME.
The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or
suspend
this Contest (or to amend these Rules) in any way, in the event of any cause beyond the
reasonable
control of the Sponsor that interferes with the proper conduct of this Contest as
contemplated
by
these Rules, including, without limitation, any error, problem, computer virus, bugs,
tampering,
unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine
the
legitimate operation of this Contest in any way (as determined by Sponsor in its sole and
absolute
discretion) may be a violation of criminal and civil laws and should such an attempt be
made,
the
Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by
law.
The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or
suspend
this
Contest, or to amend these Rules, in any way without prior notice or obligation, in the
event of
any
accident, printing, administrative, or other error of any kind, or for any other reason
whatsoever.
Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole
and
absolute discretion, to administer an alternate test of skill as it deems appropriate based
on
the
circumstances and/or to comply with applicable law.
The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the
dates,
timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed
necessary
by the Sponsor, for purposes of verifying compliance by any entrant, Draw Entry, Entry Form,
Request
and/or other information with these Rules, or as a result of any technical or other
problems, or
in
light of any other circumstances which, in the opinion of the Sponsor, in its sole and
absolute
discretion, affect the proper administration of the Contest as contemplated in these Rules,
or
for
any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these
English
Rules and disclosures or other statements contained in any Contest-related materials,
including,
but
not limited to, the French version of these Rules, point of sale, television, print or
online
advertising and/or any instructions or interpretations of these Rules given by any
representative of
the Sponsor, the terms and conditions of these English Rules shall prevail, govern and
control
to
the fullest extent permitted by law.
The invalidity or unenforceability of any provision of these Rules shall not affect the
validity
or
enforceability of any other provision. In the event that any provision is determined to be
invalid
or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and
shall be
construed in accordance with the terms as if the invalid or illegal provision were not
contained
herein.
To the fullest extent permitted by applicable law, all issues and questions concerning the
construction, validity, interpretation and enforceability of these Rules or the rights and
obligations of participants, Sponsor or any of the other the Released Parties in connection
with
the
Contest will be governed by and construed in accordance with the domestic laws of the
Province
of
Ontario and the federal laws of Canada applicable therein, without giving effect to any
choice
of
law or conflict of law rules or provisions that would cause the application of any other
jurisdiction's laws. The parties hereby consent to the exclusive jurisdiction and venue of
the
courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or
relating to this Contest.
10. Limitation of Liability
KINTON Ramen and its affiliates are not responsible for any travel-related disruptions,
delays,
loss,
or injury once the prize has been awarded. Any costs not specifically included in the prize
description are the sole responsibility of the winner.
The Sponsor and the other Released Parties will not be liable for: (i) any failure of any
platform,
during the Contest; (ii) any malfunction or other problems of any nature whatsoever,
including,
without limitation, those relating to printing malfunctions; (iii) the failure of any Draw
Entry,
Entry Form, Entry Request and/or other information to be received, captured or recorded for
any
reason whatsoever, including, but not limited to, technical problems or traffic congestion
at
any
Participating Restaurant; (iv) any injury, harm or loss of life or damage to an entrant
related
to
or resulting from participating in the Contest and you voluntarily assume all risks of any
and
all
injuries, harm or loss of life that may result from participating in the Contest; (v) anyone
being
incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any
combination
of the above.

Concours Tournée Ramen d'Été - KINTON Ramen
Règlement officiel et Modalités et Conditions
Le concours « Tournée Ramen d'Été de KINTON Ramen » avec carte à timbres (le « Concours »)
est organisé par KINTON Ramen Canada Inc. (« KINTON Ramen » ou le « Commanditaire ») et
ouvert aux résidents légaux de l'Ontario, du Québec, de l'Alberta, du Manitoba et de la
Colombie-Britannique, âgés de dix-huit (18) ans ou plus à la date de participation. Les
participants admissibles qui, au moment de la participation, ont atteint l'âge de dix-huit
(18) ans, mais n'ont pas atteint l'âge légal de la majorité dans leur province de résidence
au moment de la participation (« Mineurs ») doivent obtenir le consentement d'un parent ou
d'un tuteur légal pour participer au Concours, et ce parent ou tuteur légal doit accepter et
consentir à être juridiquement lié par le présent Règlement au nom du Mineur. Aucun achat
n'est nécessaire pour participer ou gagner.
REMARQUE AUX MINEURS : Le Commanditaire se réserve le droit, à sa seule et entière
discrétion, dans le cadre d'un audit aléatoire, de contacter le parent ou le tuteur légal
d'un Mineur afin de vérifier : (i) son accord à être juridiquement lié par le présent
Règlement au nom du Mineur; (ii) son consentement à la participation du Mineur au présent
Concours; et/ou (iii) son consentement à la collecte, à l'utilisation et à la divulgation
des renseignements personnels du Mineur. Le défaut du parent/tuteur légal d'un Mineur de
compléter toute vérification requise à l'entière satisfaction du Commanditaire dans le délai
spécifié par le Commanditaire peut, à la seule et entière discrétion du Commanditaire,
entraîner la disqualification du Mineur.
1. Période du Concours
Le Concours se déroule du 28 avril 2025 au 28 septembre 2025 (la « période du Concours »).
Les cartes de timbres doivent être remises au plus tard le 30 septembre 2025 pour être
admissible à recevoir une participation au tirage (définie ci-dessous).
2. Comment participer et récompenses
Pour participer au Concours Tournée Ramen d'Été, vous devez premièrement visiter un
restaurant KINTON Ramen participant au Canada (un « restaurant participant ») et obtenir une
carte à timbres Tournée Ramen d'Été (une « carte à timbres »).
Les participants recevront un (1) timbre pour chaque bol de ramen acheté (un « achat
admissible ») dans un restaurant participant dans le cadre d'une commande à consommer sur
place (une « transaction admissible »). Pour davantage de certitude, les commandes à
emporter, les livraisons ou les commandes passées via une application tierce ne constituent
pas une transaction admissible et ne donnent pas droit à des timbres. Il y a une limite d'un
(1) timbre par personne pour chaque transaction admissible, mais plusieurs
participants
peuvent obtenir un (1) timbre pour une même transaction admissible, à condition que
plusieurs achats admissibles aient été effectués. À titre d'exemple représentatif
uniquement, si, dans le cadre d'une seule transaction admissible, un participant achète deux
(2) bols de ramen à consommer sur place pour lui-même et son invité, le participant et son
invité seront chacun admissibles à recevoir un (1) timbre (à condition que l'invité soit
admissible à participer). Toutefois, si le même participant achète trois (3) bols de ramen
pour lui-même et son invité, le participant et son invité resteront admissibles à recevoir
un (1) timbre chacun.
Niveaux de récompenses:
Les participants qui ont collecté des timbres sur leur carte de timbres conformément au
présent règlement seront admissibles à recevoir des récompenses conformément aux modalités
suivantes :
- Après 3 timbres : un (1) dessert gratuit (selon disponibilité)
- Après 6 timbres : un (1) accompagnement gratuit (excluant les items Donburi et Karaage)
- Après 9 timbres : un (1) ramen gratuit + un (1) timbre bonus pour les KINTON Bowlers +
une (1) participation au tirage du Grand Prix (défini ci-dessous) (une « participation
au tirage »)
Tous les timbres KINTON Bowlers obtenus sont
assujettis aux modalités et conditions
régissant le PROGRAMME KINTON BOWLER.
Les cartes de timbres doivent être remises en
personne à un membre du personnel
KINTON Ramen d'un restaurant participant avant le 30 septembre 2025 afin de se qualifier
pour la récompense finale et pour recevoir une participation au tirage.
Une fois qu'un participant a obtenu neuf (9) timbres et remis sa carte de timbres à un membre
du personnel de KINTON Ramen, conformément au présent règlement, les participants doivent
remplir le formulaire de participation au Concours (qui peut inclure, sans s'y limiter,
l'obligation de fournir le nom complet et l'adresse électronique du participant) qui leur
sera fourni par un membre du personnel de KINTON Ramen sur une tablette lors de la remise de
leur carte de timbres remplie (un « formulaire de participation »). Ces coordonnées seront
utilisées uniquement pour informer le gagnant. Une fois les étapes précédentes accomplies
conformément au présent règlement, chaque participant sera admissible à recevoir une (1)
participation au tirage.
Aucun achat requis
Sinon, pour obtenir une (1) participation au tirage sans effectuer d'achat admissible tel que
décrit ci-dessus, imprimez votre prénom, votre nom et votre adresse électronique valide sur
une feuille de papier blanc, puis envoyez-la (dans une enveloppe suffisamment affranchie au
tarif canadien) accompagnée d'un texte manuscrit original et unique d'au moins cinquante
(50) mots expliquant pourquoi vous souhaitez participer au concours à l'adresse suivante :

demande de participation valide soumise et reçue conformément au présent règlement, vous
serez admissible à recevoir une (1) participation au tirage. Pour être admissible, la

enveloppe suffisamment affranchie au tarif postal canadien (c'est-à-dire que les demandes de
participation multiples dans la même enveloppe seront nulles) ; et (ii) être reçue au plus
tard le 8 octobre 2025.
Exigences de participation :
Si le Commanditaire découvre (à l'aide de toute preuve ou autre information mise à sa
disposition ou découverte par lui) qu'une personne a tenté de créer de faux timbres,
d'utiliser plusieurs noms, plusieurs identités, plusieurs adresses électroniques, tout
système ou programme automatisé, macro, script, robotique ou autre, et/ou tout autre moyen
non conforme à l'interprétation par le Commanditaire de la lettre et/ou de l'esprit du
présent règlement afin de s'inscrire ou de participer de toute autre manière au Concours ou
de perturber celui-ci, cette personne pourra être disqualifiée du Concours, à la seule et
entière discrétion du Commanditaire. Votre participation au tirage peut être rejetée ou
refusée si (à la seule et entière discrétion du Commanditaire) votre carte de
timbres/formulaire de participation/demande de participation (selon le cas) n'est pas dûment
remplie avec toutes les informations requises et soumise et reçue conformément au présent
règlement. Les parties au Concours (définies ci-dessous) et chacun de leurs dirigeants,
administrateurs, mandataires, représentants, successeurs et ayants droit (collectivement,
les « parties exonérées ») ne sont pas responsables (et n'ont aucune responsabilité à cet
égard) des formulaires de participation, demandes de participation, participations au tirage
au sort et/ou autres informations (qui sont tous nuls) en retard, perdus, mal acheminés,
retardés, incomplets ou incompatibles.
3. Détails du Grand Prix
Il y a un (1) grand prix (le « Grand Prix ») disponible à gagner, consistant en un prix de
voyage pour le gagnant confirmé et un (1) invité (un « invité »), comprenant :
- Billets d'avion aller-retour (classe économique) pour Tokyo (Japon)
- Six (6) nuitées dans un hôtel 3 étoiles à Tokyo
- 500 $ CA en argent de poche
Valeur au détail approximative (VDA): 5 500 $ CA (sur la base d'un point de départ
hypothétique à Toronto, en Ontario).
4. Conditions du prix
- Le voyage doit être effectué entre le 20 octobre 2025 et le 31 mars 2026
- Certaines dates sont exclues, y compris les fêtes majeures
- Le gagnant doit posséder un passeport valide et être admissible à entrer au Japon
- Le gagnant doit fournir une preuve d'assurance voyage valide avant la réservation
- Le Grand Prix est non cessible, non échangeable, et non remboursable en espèces
- Si le gagnant n'est pas en mesure de remplir ces conditions, le Grand Prix pourrait
être annulé
- KINTON Ramen se réserve le droit de remplacer le prix par un autre de valeur
équivalente ou supérieure si nécessaire
Sans limiter la généralité de ce qui précède, les conditions générales suivantes s'appliquent
au Grand Prix : (i) le Grand Prix doit être accepté comme attribué et n'est pas
transférable, ne peut pas être cédé et ne peut pas être converti en argent (à l'exception de
ce qui est expressément autorisé par le Commanditaire, à son entière et à sa seule
discrétion); (ii) aucune substitution n'est autorisée, sauf au choix du Commanditaire; (iii)
la participation au Grand Prix avoir lieu à la ou aux dates indiquées par le Commanditaire
ou avant celles-ci (autrement le Grand Prix peut, à l'entière et à la seule discrétion du
Commanditaire, être annulé dans sa totalité et, si le Prix est annulé, rien ne sera donné en
échange); (iv) le Gagnant confirmé du Grand Prix et son invité doivent avoir en leur
possession tous les documents requis pour participer au Grand Prix; (v) le coût de tout ce
qui n'est pas expressément indiqué ci-dessus comme inclus dans le Grand Prix est à la seule
et entière responsabilité du Gagnant du Grand Prix et son invité, y compris, mais sans s'y
limiter : les repas et les boissons, les pourboires, le divertissement, les assurances
maladie et voyages; le transport pour le gagnant confirmé du Grand Prix et son invité à
destination et en provenance de l'emplacement de départ choisi par le Commanditaire; le
transport additionnel; les frais de bagages et les autres frais; et les articles de nature
personnelle (REMARQUE : le gagnant confirmé du Grand Prix et son invité peuvent être tenus
de présenter une carte de crédit reconnue valide à leur nom au moment de l'enregistrement à
l'hôtel pour couvrir les frais accessoires); (vi) si le Gagnant confirmé du Grand Prix et/ou
son invité n'utilisent pas une partie du Grand Prix, alors cette partie non utilisée peut, à
l'entière et à la seule discrétion du Commanditaire, être annulée dans sa totalité et, en
cas d'annulation, rien ne sera donné en échange; (vii) le Commanditaire se réserve le droit,
en tout temps : (a) d'imposer des restrictions raisonnables sur la disponibilité ou
l'utilisation du Grand Prix ou de tout élément de celui-ci; et (b) de remplacer le Grand
Prix ou une partie de celui-ci pour quelque raison que ce soit par un prix ou une partie de
prix de valeur au détail égale ou supérieure, y compris, mais sans s'y limiter, mais à
l'entière discrétion du Commanditaire, un montant en argent; (viii) tous les arrangements en
lien avec le Grand Prix doivent être faits par l'entremise du Commanditaire ou de ses
mandataires désignés; et (ix) en acceptant le Grand Prix, le Gagnant confirmé du Grand Prix
accepte de renoncer à tout recours contre le Commanditaire et toutes les autres Parties
exonérées en lien avec sa participation au Grand Prix (y compris toute blessure) et/ou si le
Grand Prix ou une partie de celui-ci n'est pas satisfaisant, en totalité ou en partie.
Exigences relatives à l'invité L'invité du gagnant confirmé du Grand Prix
doit : (a) être âgé de dix-huit (18) ans ou plus, et, s'il est mineur, avoir obtenu
l'autorisation de son parent ou tuteur légal pour participer au Grand Prix; et (b) signer
(et, s'il est mineur, son parent/tuteur légal doit signer) et renvoyer la déclaration
d'exonération du Commanditaire (avant la date indiquée sur le formulaire d'exonération)
indiquant qu'il renonce à tout recours contre le Commanditaire et toutes les autres parties
exonérées en rapport avec sa participation au Grand Prix (y compris, sans limitation, tout
voyage y afférent).
Nous encourageons et il est fortement recommandé que le Gagnant confirmé du Grand Prix et son
invité obtiennent une assurance voyages et médicale suffisante avant le départ. Le transport
est assujetti à la disponibilité, aux périodes d'interdiction, aux restrictions et aux
règlements gouvernementaux, ou d'autres restrictions et règlements en matière de transport.
Le Commanditaire et les autres parties exonérées
ne seront pas responsables en cas de
retard, d'annulation, de report ou de reprogrammation d'une partie quelconque du Grand
Prix pour quelque raison que ce soit, y compris, sans s'y limiter, en raison de la
COVID-19.
REMARQUE IMPORTANTE CONCERNANT LA COVID-19 : Afin
de participer au Grand Prix, le
gagnant confirmé du Grand Prix et son invité devront se conformer strictement à tous les
protocoles COVID-19 alors en vigueur. Le non-respect de ces exigences par le gagnant
confirmé du Grand Prix et/ou son invité entraînera l'impossibilité de participer au
Grand Prix (et donc la perte du Grand Prix, à la seule et entière discrétion du
Commanditaire).
Ni le Gagnant confirmé, ni son invité, ni toute autre personne ou entité ne sera pas
dédommagé dans le cas d'un tel retard, d'une telle annulation ou d'un autre événement prévu
aux présentes. Le Commanditaire ne remplacera pas les billets perdus ou volés. Les
modifications apportées au transport, à l'hébergement et/ou aux noms des passagers ne sont
pas acceptées une fois les réservations effectuées.
5. Sélection et notification du gagnant
Le gagnant sera sélectionné par tirage au sort parmi toutes les participations reçues pendant
la période du Concours, le ou vers le 15 octobre 2025, au siège social de KINTON Ramen, en
Ontario. Le gagnant sera contacté à l'adresse électronique fournie dans le formulaire sur la
tablette. Les chances d'être sélectionné dépendent du nombre de participations admissibles
reçues conformément au présent règlement.
Si le gagnant ne signe pas et ne renvoie pas le formulaire de déclaration et d'exonération du
Commanditaire dans les sept (7) jours, conformément à la règle 6 ci-dessous, ou s'il est
jugé inadmissible, un nouveau tirage au sort pourra être organisé.
6. Processus de confirmation du gagnant admissible
PERSONNE N'EST UN GAGNANT À MOINS ET JUSQU'À CE QUE LE COMMANDITAIRE CONFIRME OFFICIELLEMENT
QU'UNE PERSONNE EST LA GAGNANTE CONFORMÉMENT AU PRÉSENT RÈGLEMENT. AVANT D'ÊTRE DÉCLARÉ
COMME ÉTANT UN GAGNANT CONFIRMÉ, chaque gagnant admissible sera tenu de : (a) répondre à une
question d'habileté mathématique sans aide mécanique ou autre (qui peut, à l'entière et à la
seule discrétion du Commanditaire, être administrée en ligne, par courriel ou par tout autre
moyen électronique, par téléphone ou dans le formulaire de déclaration et d'exonération du
Commanditaire); et (b) signer et retourner dans les sept (7) jours ouvrables qui suivent la
notification le formulaire de déclaration et d'exonération du Commanditaire, lequel (entre
autres choses) : (i) confirme la conformité au présent Règlement; (ii) confirme
l'acceptation du Grand Prix (comme attribué); (iii) exonère le Commanditaire et toutes les
autres Parties exonérées de l'ensemble des responsabilités en lien avec ce Concours, sa
participation à celui-ci et/ou l'attribution et l'utilisation/mauvaise utilisation du Grand
Prix ou de toute partie de celui-ci (y compris, mais dans s'y limiter, tout voyage lié
celui-ci); et (iv) consent à la publication, à la reproduction et/ou à toute autre
utilisation de son nom, de sa ville, de sa province, de son territoire de résidence, de sa
voix, de ses déclarations au sujet du Concours et/ou de sa photo ou autre ressemblance sans
autre avis ou compensation, dans toute publicité ou annonce réalisée par le Commanditaire ou
en son nom, peu importe le moyen et la façon, y compris par la presse écrite, par diffusion
ou par Internet. Si un gagnant admissible : (a) ne répond pas correctement à la question
d'habileté ; (b) ne renvoie pas les documents du Concours dûment remplis dans les délais
impartis ; (c) ne peut pas accepter (ou refuse d'accepter) le Grand Prix (tel qu'attribué)
pour quelque raison que ce soit ; et/ou (d) est jugé en violation du présent règlement (tel
que déterminé par le Commanditaire à sa seule et entière discrétion); il sera disqualifié
(et perdra tous ses droits au Grand Prix) et le Commanditaire se réserve le droit, à sa
seule et entière discrétion et si le temps le permet, de sélectionner au hasard un autre
participant admissible parmi les autres participations admissibles au tirage au sort,
conformément au présent règlement (auquel cas les dispositions précédentes de la présente
section s'appliqueront au nouveau gagnant admissible ainsi sélectionné).
7. Restrictions sur l'admissibilité
Le Concours n'est pas ouvert aux employés, représentants ou membres de la famille immédiate
des employés de KINTON Ramen, de ses affiliés ou de ses agences de publicité/promotionnelles
(collectivement, les « parties au Concours »).
8. Politique de confidentialité
Les renseignements personnels recueillis durant le Concours seront utilisés uniquement pour
l'administration du Concours et en conformité avec les lois canadiennes sur la protection de
la vie privée et en conformité avec la politique de confidentialité du Commanditaire
(disponible au : https://kintonramen.com/privacy-policy/). Les renseignements ne seront pas
partagés ni vendus.
9. Conditions générales
En participant, les participants reconnaissent avoir lu et accepté le présent règlement
officiel ainsi que les décisions du Commanditaire du Concours et des administrateurs, le cas
échéant, qui seront finales et exécutoires en tous points.
Ce Concours est assujetti à l'ensemble des lois fédérales, provinciales et municipales
applicables.
TOUTE PERSONNE QUI, SELON LE COMMANDITAIRE, EST JUGÉE EN INFRACTION DE L'INTERPRÉTATION PAR
LE COMMANDITAIRE DE LA LETTRE ET/OU DE L'ESPRIT DU PRÉSENT RÈGLEMENT POUR QUELQUE RAISON QUE
CE SOIT POURRAIT ÊTRE DISQUALIFIÉE EN TOUT TEMPS À L'ENTIÈRE ET À LA SEULE DISCRÉTION DU
COMMANDITAIRE.
Le Commanditaire se réserve le droit, à sa seule et entière discrétion, de retirer, modifier
ou suspendre ce Concours (ou de modifier le présent Règlement) de quelque façon que ce soit,
pour une raison hors du contrôle jugé raisonnable du Commanditaire qui entrave la bonne
conduite de ce Concours comme il est prévu par le présent Règlement, y compris, mais sans
s'y limiter, tout problème, erreur, virus informatique, bogue, falsification, intervention
non autorisée, fraude ou défaillance de quelque nature que ce soit.
Toute tentative d'entraver le déroulement légitime de ce Concours de quelque façon que ce
soit (selon le jugement du Commanditaire à son entière et à sa seule discrétion) pourrait
constituer une infraction aux lois criminelles et civiles, et si une telle tentative est
faite, le Commanditaire se réserve le droit de réclamer des dommages et intérêts dans toute
la mesure permise par la loi.
Le Commanditaire se réserve le droit, à sa seule et entière discrétion, d'annuler, de
modifier ou de suspendre le présent Concours, ou de modifier le présent Règlement, de
quelque façon que ce soit sans avis ni obligation préalables, dans le cas d'un accident,
d'une erreur d'impression ou administrative, ou de toute autre erreur de quelque nature que
ce soit, ou pour toute autre raison de quelque nature que ce soit.
Sans limiter la généralité de ce qui précède, le Commanditaire se réserve le droit, à son
entière et à sa seule discrétion, de faire passer un autre test d'habileté selon ce qu'il
juge approprié en fonction de la situation et/ou pour se conformer aux lois applicables.
Le Commanditaire se réserve le droit, à sa seule et entière discrétion, des échéanciers et/ou
d'autres aspects du déroulement du Concours indiqués dans le présent Règlement, dans la
mesure jugée nécessaire par le Commanditaire, afin de vérifier la conformité au présent
Règlement de tout participant, toute participation au tirage, tout formulaire de
participation, toute demande de participation et/ou de tout autre renseignement, ou à la
suite de tout problème, ou à la lumière de toute autre circonstance qui, selon le jugement
du Commanditaire, et à son entière et à sa seule discrétion, entrave la bonne administration
du Concours prévue dans le présent Règlement, ou pour toute autre raison.
En cas de disparité ou d'incohérence entre les Conditions générales du présent Règlement et
des déclarations ou autres énoncés contenus dans les documents liés au Concours rédigés en
anglais, y compris, mais sans s'y limiter : la version française du présent Règlement, la
publicité au point de vente, la publicité à la télévision, la publicité imprimée ou la
publicité en ligne et/ou toute instruction ou interprétation de ce Règlement donnée par un
représentant du Commanditaire; les Conditions générales du Règlement en anglais prévaudront,
régiront et contrôleront dans toute la mesure permise par la loi.
L'invalidité ou l'inapplicabilité de toute disposition du présent Règlement n'aura aucun
effet sur la validité ou l'applicabilité de toute autre disposition. Dans le cas où une
disposition est jugée invalide ou autrement inapplicable ou illégale, le présent Règlement
restera en vigueur et devra être interprété conformément aux modalités comme si la
disposition invalide ou illégale n'en faisait pas partie.
Dans toute la mesure permise par les lois applicables, tous les problèmes et toutes les
questions concernant la formulation, la validité, l'interprétation et l'applicabilité du
présent Règlement ou des droits et obligations des participants, du Commanditaire ou de
toute autre Partie exonérée en lien avec ce Concours seront régis et interprétés
conformément aux lois internes de la province de l'Ontario et aux lois fédérales du Canada
applicables aux présentes, sans pour autant donner effet à tout choix de compétence
législative, de règles de conflit de lois ou de dispositions qui entraîneraient
l'application des lois de tout autre territoire. Les parties acceptent par les présentes
l'exclusivité de compétence et de lieu des tribunaux de la province de l'Ontario dans toute
action pour appliquer (ou autrement en lien avec) ce Règlement ou en lien avec le présent
Concours.
10. Limitation de responsabilité
KINTON Ramen et ses sociétés affiliées ne sont pas responsables des perturbations, retards,
pertes ou blessures liés au voyage une fois le prix remis. Tous les frais non spécifiquement
inclus dans la description du prix sont à la charge exclusive du gagnant.
Le Commanditaire et les autres parties exonérées ne peuvent être tenus responsables : (i) de
toute défaillance d'une plateforme pendant le Concours; (ii) de tout dysfonctionnement ou
autre problème de quelque nature que ce soit, y compris, sans s'y limiter, ceux liés à des
problèmes d'impression; (iii) de la non-réception, la non-capture ou l'enregistrement, pour
quelque raison que ce soit, d'une participation au tirage, d'un formulaire de participation,
d'une demande de participation et/ou d'autres informations, y compris, sans s'y limiter, des
problèmes techniques ou de congestion du trafic dans un restaurant participant ; (iv) toute
blessure, tout préjudice ou tout décès d'un participant lié à ou résultant de la
participation au Concours, et vous assumez volontairement tous les risques de blessures, de
préjudices ou de décès pouvant résulter de la participation au Concours ; (v) toute personne
identifiée de manière incorrecte et/ou erronée comme gagnant ou gagnant admissible ; et/ou
(vi) toute combinaison des éléments ci-dessus.
